The concept of "presumption of innocence" in the law (or both in the UK and U.S. law) is largely unknown. the only people bound by the presumption of innocence are the jury in a trial. (or judge if a test) A government agency is perfectly free to assume from the outset that you have violated the law, and proceed on that basis. Only if your case comes to trial the issue of "innocent until proven otherwise" come in. For the BBC to "leave you alone, yes, you must convince them that you are not breaking the law. If you can not (or will not) do, and they decide to forward your file to the CPS for prosecution, then, when the cases reach trial, the burden and the Crown must prove to a jury that you are guilty. It is while the presumption of innocence, comes into play. The same rules apply - in all common law countries - ANY criminal charges. The police need only "reasonable suspicion" to examine you. Once they begin to investigate, they are free to think that you are guilty, and go from there. Only if they bring you to a trial they need to prove it. Richard
